1. Identification and Acceptance
Acompanantes Argentina (hereinafter, “Acompanantes Argentina“, “the Site” or “we”) is an online advertising platform oriented towards the Argentine market. These Terms and Conditions regulate the use of the Site and the contracting of advertising spaces.
Accessing, browsing, or contracting any service on Acompanantes Argentina implies full and unreserved acceptance of these Terms. If you do not agree, you must leave the Site.
Any queries, requests, or formal notifications may be directed to the channels indicated in point 18.
2. Definitions
- User / Visitor: A person who accesses the Site to consult advertising content.
- Advertiser: A natural person of legal age who contracts advertising space to promote their independent professional services as an escort, masseuse, or adult content creator.
- Membership: An advertising plan contracted by the Advertiser with a defined duration and characteristics.
- Content: Texts, photographs, videos, and any material published by the Advertiser in their advertisement.
3. Legal Capacity and Age of Majority
To use Acompanantes Argentina, whether as a User or Advertiser, you must be over 18 years of age in accordance with Argentine legislation (Art. 25 of the Civil and Commercial Code).
The Site contains adult material. By entering, you declare under oath that you are of legal age, that adult material is not offensive to you, and that your access does not violate the applicable law of your place of residence.
Displaying, retransmitting, or distributing Site content to persons under 18 years of age may constitute the offenses set forth in Arts. 128 and 129 of the Penal Code.
4. Description of the Service
Acompanantes Argentina is an online advertising platform. Our role is limited to hosting and displaying the advertisements that each Advertiser voluntarily and independently creates.
- We are not an agency, intermediary, representative, or employer of the Advertisers.
- We do not participate in, organize, or intervene in the meetings, services, or transactions that the Advertiser agrees upon with third parties.
- We do not guarantee the completion of contacts or the veracity of the data that the Advertiser chooses to publish (beyond the visual identity verification described in point 5).
5. Registration and Verification of the Advertiser
To publish an advertisement, the Advertiser must complete an initial verification process that includes:
- Submission of a current ID, passport, or driver’s license.
- Visual comparison between the photographs to be published, a verification video, and the submitted document.
- Express confirmation of legal age and acting voluntarily and independently.
Without verification, there is no publication. Acompanantes Argentina reserves the right to reject registrations without stating a cause when there is a reasonable doubt regarding the identity, age, or willingness of the applicant.
Monthly Periodic Verification
Additionally, Acompanantes Argentina performs a monthly verification via a video in which the Advertiser mentions the current publication date. This verification confirms that the person holding the advertisement is still the same person who was verified at the time of registration and that the published content corresponds to that person. Unjustified refusal or delay in complying with this verification authorizes the suspension of the advertisement until it is regularized.
Submitting false or altered documents, or using third-party identities, constitutes a crime under Arts. 138, 139, and 292 to 298 of the Penal Code and authorizes an immediate criminal complaint.
6. Obligations and Declarations of the Advertiser
By publishing, the Advertiser declares and guarantees, under their sole responsibility, that:
- They are over 18 years of age and act on their own behalf and will, without coercion, deception, or third-party intervention.
- The photographs, videos, and data published belong to them or they have express and verifiable authorization to use them.
- They do not reproduce third-party material without consent, respecting the right to one’s own image (Art. 53 of the Civil and Commercial Code and Art. 31 of Law 11.723).
- The information in the advertisement is truthful and up-to-date.
- They carry out their activity personally, autonomously, and on their own account, without dependency or subordination to Acompanantes Argentina.
- They will hold Acompanantes Argentina harmless from any third-party claims arising from their content or activity (see point 14).
7. Prohibited Content and Criminally Sanctionable Conduct
It is absolutely prohibited to publish, in any form, content that involves or constitutes:
A) Crimes Against the Sexual Integrity of Minors
- Any representation of persons under 18 years of age in a sexual or sexualized context (Art. 128 of the Penal Code – production, distribution, and possession of child sexual abuse material).
- Contacting minors for sexual purposes through electronic means (grooming – Art. 131 of the Penal Code).
- Facilitating or promoting the prostitution of minors (Art. 125 bis of the Penal Code).
B) Human Trafficking and Exploitation
- Recruitment, transportation, reception, or sheltering of persons for exploitation purposes (Arts. 145 bis and 145 ter of the Penal Code, Law 26.842).
- Promoting or facilitating prostitution through deception, violence, threats, abuse of authority, or taking advantage of a situation of vulnerability (Art. 126 of the Penal Code).
- Economic exploitation of another’s prostitution – pimping (Art. 127 of the Penal Code).
C) Dissemination of Intimate Images Without Consent
- Publication or dissemination of intimate material of third parties without express consent (Law 27.736 – Olimpia Law).
- Coercion through the threat of disseminating intimate images – sextortion.
D) Computer Crimes (Law 26.388)
- Unauthorized access to systems, computer damage, identity theft, and phishing.
- Any content that compromises the security of the Site or its Users.
E) Other Prohibited Content
- Personal data of third parties without consent.
- Material protected by copyright without a license (Law 11.723).
- Discrimination, incitement to hatred, or violence (Law 23.592).
- Explicit or priced offers of sexual services. Advertisements promote companionship, massages, or content creation; agreements between consenting adults are made privately and off the Site.
F) Additional Editorial Restrictions
As an internal platform policy to guarantee identity traceability and prevent vulnerability situations, Acompanantes Argentina does not accept advertisements that include:
- Persons with facial tattoos that affect visual identity verification.
- Pregnant persons, at any stage of gestation.
The application of these restrictions is discretionary and does not require additional justification to the Advertiser.
Consequences:
- Non-compliance with A) to E): Immediate removal without refund, criminal complaint to competent authorities, and preservation of digital evidence.
- Non-compliance with F): Rejection or removal without refund of unused period.
8. Memberships, Prices, and Payments
- The membership plans, their characteristics, and prices are published in the corresponding section of the Site and may be updated at any time. Changes do not affect memberships already contracted during their validity.
- Payments are made through the means enabled on the Site.
- Acompanantes Argentina does not store complete data; processing is carried out by the chosen payment provider.
9. Validity, Renewal, and Cancellation
- Each membership has the duration indicated at the time of contracting.
- Renewal is not automatic unless expressly enabled by the Advertiser.
- The Advertiser may request the cancellation of their advertisement at any time, without needing to justify, by writing to [email protected]. The cancellation is processed immediately.
- Early cancellation before the expiration of a paid membership does not generate a refund for the unused period, except for causes attributable to Acompanantes Argentina.
10. Suspension and Removal of Advertisements
Acompanantes Argentina may suspend, modify, or remove an advertisement, in whole or in part and without prior notice, when:
- It detects a violation of these Terms or the Company Policy.
- It receives a verifiable report of illegal content.
- Required by a judicial or police authority through a formal order.
- There are indications of the commission of any of the crimes listed in point 7.
- The Advertiser fails to comply with the monthly periodic verification described in point 5.
In cases where the suspension is due to a cause attributable to the Advertiser, there is no refund.
11. Cooperation with Criminal Justice and Evidence Reservation
Acompanantes Argentina fully cooperates with Argentine judicial and police authorities in response to legitimate and formal requests (court orders, digital raids).
Upon detection, suspicion, or verifiable report of the commission of the crimes listed in point 7, Acompanantes Argentina proceeds to:
- Immediately remove the content.
- Preserve available digital evidence: dates and times, verification document, initial and monthly verification videos, published content, internal communications, and payment receipts.
- Report to the competent authorities when appropriate, without the need for a prior order, especially in cases of crimes against minors and human trafficking.
- Close the Advertiser’s account and prevent new registrations using data identified as linked to the conduct, within the Site’s technical capabilities.
The Advertiser acknowledges and accepts that submitting false information or using the Site for illicit purposes exposes them to corresponding criminal and civil actions, for which they are solely responsible.
12. Intellectual Property of the Site
The design, code, brands, logos, and all proprietary content of Acompanantes Argentina are protected by Law 11.723 and Law 22.362 on Trademarks. Their use, reproduction, or adaptation without authorization is prohibited.
The Advertiser retains ownership of their published content but grants Acompanantes Argentina a free, non-exclusive, and limited license for the duration of the advertisement to host, display, and promote it within the Site and its official channels.
13. Limitation of Liability
Acompanantes Argentina is not responsible for:
- The agreements, meetings, or transactions that the Advertiser enters into with third parties.
- The veracity of the advertisement data, beyond the identity verification described in point 5.
- Unlawful conduct of the Advertiser or third parties using the Site in violation of these Terms.
- Damages arising from the temporary impossibility of accessing the Site due to technical reasons, force majeure, or unforeseeable circumstances.
- Content of external linked sites.
This limitation does not apply in cases of fraud or gross negligence on the part of Acompanantes Argentina, in accordance with Art. 1743 of the Civil and Commercial Code
14. Indemnity
The Advertiser agrees to hold Acompanantes Argentina harmless from any administrative, judicial, or criminal claim initiated by third parties as a consequence of the published content or the Advertiser’s activity, assuming the associated legal costs, fees, and possible judgments.
15. Privacy and Personal Data
The processing of personal data is governed by our Privacy Policy and by Law 25.326. The enforcement authority is the Agency for Access to Public Information (AAIP), to which any data subject may file a complaint.
16. Modification of the Terms
Acompanantes Argentina may modify these Terms at any time. The current version is the one Acompanantes Argentina published on this page, with its update date at the top. Substantial changes are notified to active Advertisers via their registered email.
If an Advertiser does not accept a modification, they may request cancellation as per point 9.
- Applicable Law and Jurisdiction
These Terms are governed by the laws of the Republic of Argentina. For any controversy, the parties submit to the ordinary courts seated in the Autonomous City of Buenos Aires.
